1. Scope

1.1. References to “we,” “us,” or “our” refer to Potionix Limitada, while “you,” “your,” or “yours” refer to the user or client accessing our services.
1.2. These Terms of Use (“Terms”) regulate your use of Potionix Limitada website (“Platform”) and over-the-counter (OTC) trading services.
1.3. You are responsible for ensuring that your employees, agents, or contractors authorized to access our services (“Authorized Users”) understand and comply with these Terms. You are also liable for any breach committed by them.
1.4. Upon approval as a client or counterparty, you may be issued an electronic trading account (“Account”) with login credentials. It is your responsibility to secure these credentials. Potionix Limitada is not obligated to verify the identity of anyone using the Account with valid credentials.
1.5. The rights granted under these Terms apply exclusively to you and are not extended to your subsidiaries or affiliated entities.

2. Your Responsibilities

2.1. You agree, and will ensure that your Authorized Users agree, not to:

• Disrupt, overload, or compromise the functionality of the Platform, including through denial-of-service attacks;
• Breach or attempt to breach the Platform’s security measures;
• Replicate, modify, or distribute any part of the Platform;
• Reverse engineer or decompile any portion of our services;
• Use the Platform to develop competing products;
• Sell, lease, or sublicense our services to third parties; or
• Assist unauthorized parties in accessing our services.
  2.2. You must take reasonable steps to prevent unauthorized access to your Account and notify us immediately if such access occurs.

3. Licensing

Under these Terms, we grant you a non-transferable, non-exclusive license to use our services for your own purposes. All intellectual property rights related to our services, including trademarks, remain the property of Potionix Limitada or our licensors.

4. Limitation of Liability

Our services are provided “as is” and “as available,” with no guarantees of uninterrupted, error-free, or virus-free operation. We disclaim all warranties, including those of merchantability, fitness for purpose, and non-infringement. External factors beyond our control may affect service performance, and we do not guarantee the value, quality, or accuracy of any quoted currency.

5. Risks in Electronic Trading

Using electronic systems for trading involves risks such as software, hardware, or connectivity failures. We accept no responsibility for such failures or any resulting losses.

6. Electronic Communication

6.1. By using our services, you consent to receive communications from us electronically instead of in paper form.
6.2. Communications are deemed delivered when:

• Posted on the Platform;
• Sent to the email associated with your Account; or
• Provided through our services.
  6.3. It is your responsibility to keep your contact information current to ensure you receive our communications. If you fail to do so, we will consider the communication delivered.

7. Amendments

We may revise these Terms at any time by updating them on the Platform. The updated Terms take effect immediately upon posting. While we may notify you of changes, your continued use of our services constitutes acceptance of the revised Terms, even if no notice is provided.

8. Governing Law

These Terms are governed by the laws of Union of Comoros.
